The Madhya Pradesh High Court recently imposed community service as a condition for granting temporary bail to a college student accused of sexual harassment [Abhishek Sharma v The State of Madhya Pradesh].
In a single-judge order dated May 16, Justice Anand Pathak expressed the view that while the allegations were serious, the student deserved an opportunity to correct his behavior and improve himself.
The Court agreed with the suggestion made by the counsel for the accused-applicant to grant temporary bail for two months. The counsel suggested that during this period, the accused should engage in creative activities and community service to reflect on his actions and demonstrate positive conduct.
The accused had been arrested on April 4 on charges of harassing a girl via WhatsApp, stalking, and making vulgar calls. In his plea for temporary bail, he argued that his prolonged confinement would adversely affect his academic pursuits as a first-year BBA student.
He pledged not to cause any further embarrassment or harassment to the complainant and assured compliance with all conditions set by the Court. Additionally, his parents undertook to supervise and ensure his adherence to these conditions.
The Court acknowledged the severity of the allegations, especially considering the accused’s background and aspirations. However, it believed in offering him a chance for self-improvement and rehabilitation.
As a temporary measure, the Court granted bail for two months with specific directions for community service. The accused was ordered to render services at the District Hospital (1250) Bhopal every Saturday and Sunday from 9 am to 1 pm, assisting patients under the supervision of medical staff. He was prohibited from entering the operation theatre or administering any medical treatment.
The Court emphasized that these tasks would provide the accused with basic education in first aid and disaster management, facilitating his integration into society and potential future roles as a disaster management volunteer.
The matter is scheduled for the next hearing on July 22.
