The Bombay High Court has instructed the Mumbai Police to ensure that a woman, currently in Uttar Pradesh, is brought before the court following a plea filed by her husband, who claimed that his wife was kidnapped two weeks ago.
The bench, comprising Justices Dr. Neela Gokhale and Ashwin Bhobe, heard the petition filed by Pradeep Rajesh Kumar Gupta. Gupta’s counsel, Advocate Mukesh Gupta, informed the court that the couple had married out of love, despite coming from different castes. The petitioner claimed that his wife, Pooja Gulab Yadav (now known as Pooja Pradip Gupta), had suddenly disappeared, and despite multiple attempts to locate her through complaints, he had been unsuccessful and subsequently approached the High Court.
Advocate Gupta further argued that Pooja’s family had long objected to their inter-caste marriage. He alleged that they had used deceptive means to take her to Uttar Pradesh, citing that her family called her back under pretenses.
Dr. Ashvini Takalkar, the Additional Public Prosecutor representing the Sakinaka Police, stated that the investigating officer had contacted Pooja, who confirmed that she was in Uttar Pradesh and had traveled there of her own volition.
After hearing the submissions, the bench directed the Sakinaka Police to produce Pooja Gulab Yadav alias Pooja Pradip Gupta before the court on January 6, 2025. Additionally, the bench ordered that the investigating officer serve a notice to Yadav’s parents, informing them about the hearing, and allowing them to present their side before the court.
