The Delhi High Court recently granted interim relief to radio broadcaster Mirchi in a copyright infringement case against entertainment and lifestyle platform MissMalini. The case pertains to the unauthorized upload of clips from the talk show What Women Want, hosted by Bollywood actress Kareena Kapoor Khan, on social media platforms YouTube and Instagram. The lawsuit is titled Entertainment Network India Limited v. Miss Malini Entertainment Pvt Ltd And Others.
Entertainment Network India Limited (ENIL), which operates Mirchi FM, accused MissMalini Entertainment Private Limited (MEPL) of violating an agreement by posting video clips from the show without approval. ENIL alleged that MEPL removed the Mirchi logo from the clips, replaced it with the MissMalini logo, and credited the clips to “MissMalini Productions.” Mirchi asserted that it is the exclusive owner of the intellectual property rights for the show.
Mirchi further claimed that MEPL was hired to promote the show under a mutual understanding that Mirchi would review all content before its publication. However, MEPL allegedly bypassed this agreement and uploaded the clips without prior clearance.
On December 20, Justice Mini Pushkarna granted an ex parte interim injunction in favor of Mirchi, ordering MEPL to remove the contentious clips from YouTube and Instagram within 48 hours, which has since been complied with. The Court also restrained MEPL from using Mirchi’s copyrighted material on any platform until the next hearing, scheduled for May 13, 2025.
Before approaching the Court, Mirchi had issued a cease-and-desist notice to MEPL and filed copyright strikes on YouTube. However, as some clips remained accessible online, Mirchi sought judicial intervention for complete removal and additional safeguards.
Representing Mirchi were Senior Advocate Abhishek Malhotra and Advocates Kartikay Dutta, Anukriti Trivedi, and Raghavi Shukla. Advocates Vedansh Anand and Sachin Saraswat appeared for the Central government, while Google was represented by Advocates Aditya Gupta and Asavari Jain. Counsel Nidhi Raman, alongside Advocate Akash Mishra, represented the Union Ministry of Electronics and Information Technology and the Department of Telecommunications.
