The Supreme Court has deferred NewsClick founder Prabir Purkayastha’s plea for release on medical grounds to the first week of April. Purkayastha has been in custody since October 2 last year, facing charges under the Unlawful Activities (Prevention) Act, which include allegations of receiving Chinese funding to propagate anti-national sentiments.

During the previous hearing, the bench, consisting of Justices BR Gavai and Sandeep Mehta, had instructed the formation of a board by the All India Institute of Medical Science (AIIMS) for an independent medical assessment of Purkayastha. Today, the Court was informed that the AIIMS panel’s report had been submitted. Consequently, the Court ordered that a copy of the report be provided to Purkayastha and his legal representatives.

The decision to postpone the matter until after the Holi vacations indicates that the Court is giving careful consideration to the medical report and its implications for Purkayastha’s case. The delay in the proceedings suggests that the Court is taking a cautious approach to ensure that all relevant information is thoroughly examined before making a decision.

Purkayastha’s case has attracted significant attention due to its implications for freedom of speech and the press in India. The allegations against him highlight the challenges faced by journalists and media organizations in the country, particularly those critical of the government.

The decision to seek an independent medical evaluation indicates the Court’s recognition of the importance of ensuring that Purkayastha’s health is properly assessed and that he receives appropriate medical care if necessary. This approach reflects the Court’s commitment to upholding the principles of justice and fairness in all cases, including those involving high-profile individuals like Purkayastha.

Overall, the Supreme Court’s decision to postpone the hearing demonstrates its commitment to ensuring that justice is served fairly and transparently, even in complex and contentious cases like that of Prabir Purkayastha.
